These Terms of Service (“Terms”) govern your use of the Etera mobile application, website, and related services (“Platform”) operated by Etera Technologies FZCO, a company incorporated under the laws of the United Arab Emirates, with its registered office in Dubai Silicon Oasis, Dubai, UAE (“Etera,” “we,” “our,” or “us”).
By creating an account, making a booking, or using our Platform, you agree to these Terms and to our Privacy Policy.
If you do not agree, you must not use Etera.

Introduction
Etera Technologies FZCO provides an online platform that enables users to search, book, and pay for travel, transportation, accommodation, and lifestyle services.
Etera acts as the Merchant of Record for all bookings made through the Platform, meaning that payments are made directly to Etera, and users receive invoices and receipts from Etera.
These Terms form a legally binding agreement between you and Etera Technologies FZCO.
Your continued use of the Platform constitutes acceptance of the latest version of these Terms.
Definitions
For the purpose of these Terms:“Platform” refers to the Etera mobile and web applications and all associated interfaces.
“User” means any individual or entity accessing or using the Platform.
“Booking” means any confirmed reservation made through Etera for travel, accommodation, or related services.
“Vendor” or “Partner” refers to hotels, transportation providers, activity operators, or other service providers listed on Etera.
“Services” refers collectively to the offerings available for booking through the Platform.
“Merchant of Record” means Etera is the contracting entity responsible for processing and collecting payments on behalf of vendors.
Scope of Services
Etera provides a unified platform for booking travel and lifestyle services.
Etera facilitates the purchase, payment, and confirmation process for Users and Vendors.
While Etera is the contracting merchant for payment, the actual service is fulfilled by the Vendor.
Etera reserves the right to modify, limit, or suspend certain Platform functions at any time, including for maintenance, upgrades, or regulatory reasons.
Account Registration
To use certain features, you must create an account.
You agree to:
Provide accurate, complete, and current information during registration.
Maintain the confidentiality of your login credentials.
Notify Etera immediately of any unauthorized access or misuse.
You must be at least 18 years old and have the legal authority to enter into binding contracts in order to make a booking through Etera. By completing a booking, you confirm that you meet this requirement and that all information you provide is truthful and accurate.
Users under 18 may browse the Platform but cannot make purchases or bookings.
Bookings that include minors must be made by an adult who assumes full responsibility for the reservation and for compliance with all related travel or activity requirements.
Etera reserves the right to suspend or terminate any account that provides false information, violates these Terms, or is used for unlawful or fraudulent purposes.
Booking Process
All bookings made through Etera are subject to availability and Vendor confirmation.
A booking is considered confirmed only when you receive an email or in-app confirmation.
You are responsible for verifying all booking details before payment. By completing a booking, you agree to the applicable Vendor terms, including check-in policies, cancellation rules, and local requirements.
Payments and Pricing
Etera acts as the Merchant of Record for all transactions.
Payments are processed securely through approved providers such as Stripe or other licensed processors.
Prices displayed on the Platform include applicable taxes and fees unless stated otherwise.
In some cases, local taxes or charges may be collected by the Vendor upon arrival.
All charges appear under “Etera” or “Etera Technologies FZCO” on your payment statement.
You agree to provide valid payment information and authorize Etera to charge the full amount at the time of booking.
Etera reserves the right to correct pricing errors and cancel affected bookings, with full refunds provided.
Cancellations and Refunds
Cancellation and refund policies vary depending on the Vendor and the specific Service.
The applicable policy is displayed during the booking process and on your confirmation.
If eligible for a refund, Etera will process it within a reasonable period, typically 7–14 business days, to the original payment method.
Refunds may be subject to currency conversion, bank, or processing fees.
Etera reserves the right to deny refunds in cases of misuse, fraud, or non-compliance with Vendor terms.
User Obligations
By using the Platform, you agree to:
Use the Platform only for lawful, personal, and non-commercial purposes.
Refrain from reselling, redistributing, or scraping data from the Platform.
Provide accurate personal and payment information.
Comply with all travel, visa, and health requirements applicable to your booking.
You are solely responsible for the accuracy of your booking information and any consequences arising from errors or omissions.
Vendor Obligations and Responsibilities
Vendors listed on Etera are independent service providers.
They are solely responsible for:
Fulfilling bookings according to their stated terms.
Providing accurate descriptions, images, and pricing.
Ensuring compliance with local laws, permits, and safety standards.
Etera is not responsible for the actions, omissions, or quality of service provided by Vendors.
Etera’s Responsibilities and Disclaimers
Etera ensures the secure operation of the Platform and proper processing of payments as the Merchant of Record.
However, Etera does not guarantee uninterrupted availability, error-free operation, or continuous access to the Platform.
All Services are provided “as available” and “as is.”
Etera is not liable for:
Vendor performance or cancellation.
External factors such as weather, force majeure, or government restrictions.
Technical or network failures beyond its control.
Etera’s total liability, in any case, shall not exceed the amount paid by the User for the specific booking giving rise to the claim.
Intellectual Property
All trademarks, software, text, design elements, and content available on the Platform are owned or licensed by Etera Technologies FZCO.
You are granted a limited, non-exclusive, and non-transferable license to access and use the Platform solely for personal, lawful purposes.
You may not copy, reproduce, modify, reverse engineer, or distribute any part of the Platform without Etera’s written consent.
Limitation of Liability
To the fullest extent permitted by law:
Etera shall not be liable for indirect, incidental, or consequential damages, including loss of profit, goodwill, or data.
Etera’s total aggregate liability is limited to the total amount paid for the booking in question.
Nothing in these Terms limits liability for fraud, gross negligence, or death caused by willful misconduct.
Termination
You may terminate your account at any time by contacting Etera.
Etera may suspend or terminate access if you:
Breach these Terms or applicable laws.
Misuse the Platform or engage in fraudulent activity.
Cause harm to other Users, Vendors, or Etera’s operations.
Termination does not affect your existing booking obligations or payment liabilities.
Governing Law and Dispute Resolution
These Terms and any related disputes are governed by the laws of the United Arab Emirates.
Unless otherwise agreed in writing, disputes shall be subject to the exclusive jurisdiction of the courts of Dubai, United Arab Emirates.
Etera encourages users to contact our support team first to attempt amicable resolution before pursuing legal action.
Modifications to the Terms
Etera may update these Terms at any time to reflect operational, legal, or regulatory changes.
The updated version will be published on our website and mobile app with a revised “Last Updated” date.
Your continued use of the Platform after such updates constitutes acceptance of the revised Terms.
Miscellaneous
Force Majeure: Etera is not responsible for delays or failures caused by events beyond its control.
Severability: If any clause is deemed invalid, the remainder remains enforceable.
No Waiver: Failure to enforce any right does not waive it.
Entire Agreement: These Terms and the Privacy Policy form the entire agreement between you and Etera Technologies FZCO regarding your use of the Platform.
Consumer Notice and Dispute Procedure
Etera Technologies FZCO is committed to fair treatment and transparent communication with all users worldwide.
If you are a consumer located in the European Union, United Kingdom, or United States, you have specific rights under consumer protection law.
This section describes how complaints and disputes are handled.
Your Right to Complain
You may submit any complaint, inquiry, or dispute to our customer service team by emailing support@etera.tech.
We aim to acknowledge all complaints within five (5) business days and provide a substantive response within fifteen (15) business days.
If the issue cannot be resolved promptly, you will be informed of the next steps and expected timeline.
Alternative Dispute Resolution (EU/UK Users)
If you are an EU or UK consumer and remain unsatisfied after contacting us, you may access an independent out-of-court settlement body via the Online Dispute Resolution (ODR) platform of the European Commission:

Participation in ODR is voluntary but demonstrates good-faith cooperation.
Nothing in this clause limits your statutory right to bring proceedings before the competent local court.
Arbitration Option (U.S. Users)
For users located in the United States, any dispute that cannot be resolved through customer service may, by mutual agreement, be referred to binding arbitration in accordance with the rules of the American Arbitration Association (AAA).
The arbitration will be conducted in English and held virtually or in Dubai, United Arab Emirates, unless otherwise agreed.
Each party will bear its own legal costs unless the arbitrator decides otherwise.
Consumers retain the right to bring eligible claims in small-claims court instead of arbitration.
Notice and Process
Before initiating arbitration or court proceedings, the complaining party must send a written notice describing the nature of the dispute, the facts giving rise to it, and the relief sought.

Etera will respond within thirty (30) days of receiving the notice.
Both parties agree to attempt good-faith negotiation before formal proceedings.
Non-Waiver of Consumer Rights
Nothing in these Terms limits or excludes any mandatory consumer rights under applicable law.
If a clause conflicts with a statutory consumer protection rule, that rule will prevail in your jurisdiction.
